Terms & Conditions

1. Eligibility to participate: Advent calendar

All persons aged 18 and over are eligible to participate. Only passengers who have traveled in a MOIA Advent Calendar vehicle during the campaign period and meet the campaign conditions can take part in the campaign. As a general rule, it is not possible to actively book a MOIA with a specific Advent calendar number, as the allocation of vehicles is purely random.

2. Promotion period / priority principle

The campaign begins on December 1 and ends on December 24. Additional vouchers will be issued on St. Nicholas Day (6.12.) and Christmas Eve (24.12.). They will be issued by the drivers on the respective day according to the priority principle (“first come, first serve”). If several passengers board the vehicle at the same time and the number of available goodies or vouchers is limited so that not every passenger can receive a voucher, the driver will decide who receives the voucher in case of doubt  

3. Goodies / voucher

Every passenger who happens to board the right vehicle on the right day will receive a bar of “Share” chocolate while stocks last. On December 6 and 24, there is a chance to receive one of a total of 10 Hamburg experience vouchers (worth €100 each), provided the trip in the MOIA was made on the correct date with the matching Advent number 

Example scenario surprise “Share” chocolate: If you are seated on 3.12. in the Advent MOIA with the large Advent calendar number “3” (not to be confused with the small vehicle number), you will only receive the “Share” chocolate and only while stocks last.  

Example scenario “Vouchers” incentive: The procedure described above also applies to the voucher campaign. A total of 10 Hamburg Experience vouchers - five each on December 6 and five on December 24 according to the priority principle - are issued by the drivers 

4. Determination of the winners

The winners of the vouchers will be determined by our drivers on December 6 and 24 on board the vehicles according to the priority principle (first-come-first-serve) and handed over directly. In addition, the people who have received a voucher will be documented by the driver 

5. Information on Data Protection  

No data is requested when the share chocolate is issued 

However, personal data (first name, surname, e-mail address) as well as boarding time and vehicle number are requested from the driver via a form for the purpose of issuing the experience vouchers worth €100. The data is stored for up to 15 years for tax reasons.  

In this context, the protection of personal data for the purposes of running the competition is of particular concern to us.

I. General information on data processing    

a. Who is responsible for data collection and processing?   

The controller pursuant to Art. 4 (7) of the EU General Data Protection Regulation (GDPR) is MOIA GmbH, Alexanderufer 5, 10117 Berlin. If you have any questions about data protection, you can also contact the controller at privacy@moia.io    

b. What data do we collect and how and why do we process your data?   

We collect and process your data exclusively for the purpose of the correct processing and execution of the competition, for the delivery of the prizes and for tax accounting.    

To fulfill this purpose, we process the following personal data     

  • First name and surname,
  • e-mail address ,
  • journey details (boarding time and vehicle number)  

The processing of this data for the above-mentioned purpose is necessary for the performance of a contract with you and is carried out on the legal basis of Article 6(1)(b) GDPR.    

c. Will data be passed on?  

Winners' data will only be passed on to MOIA GmbH for billing purposes.  

We only store the data collected as part of the competition for as long as it is necessary to fulfill the purpose for which it was collected. After the competition has ended, the data will be stored for 15 years.

II. Your rights  

You have the following rights with regard to the personal data concerning you, which you can assert against us by notifying us using the contact details provided:   

Right of access (Art. 15 GDPR),   

Right to rectification (Art. 16 GDPR) or erasure (Art. 17 GDPR),   

Right to restriction of processing (Art. 18 GDPR),   

Right to object to processing (Art. 21 GDPR),   

Right to withdraw your consent (Art. 7 para. 3 GDPR),   

Right to receive the data in a structured, commonly used, machine-readable format (“data portability”) and the right to transmit the data to another controller if the requirements of Art. 20 para. 1 lit. a, b GDPR are met (Art. 20 GDPR).  

6. Exclusion

Legal recourse is excluded. MOIA employees and their relatives are excluded from participation.
